    HUD announced the availability on http://www.Grants.gov and its website at http://www.hud.gov/ offices/adm/grants/nofa10/grpshop.cfm a technical correction to the FY 2010 NOFA for the Self-Help homeownership Opportunity Program (SHOP).  HUD's notice corrects the Threshold Requirement in the NOFA to make clear that a SHOP applicant and its affiliates must qualify as eligible public or private nonprofit organizations under federal or state law. HUD's Notice also corrects sections in the NOFA that relate to this threshold requirement.  HUD's notice also makes applicants aware of a correction to the eLogic Model form HUD 96010 SHOP V12.3 012811. The coding in the form originally posted did not allow the macros to function properly. The coding has been corrected and the corrected HUD 96010 SHOP V12.3 030311 form is contained in the Instructions Download.  Applicants that have already submitted an application using an earlier version of the eLogic Model, should pull a new Logic Model from the instructions download, complete a new eLogic Model, attach the new Logic Model to their application, and resubmit the application. The Technical Correction also extends the deadline date for the Self-Help homeownership Opportunity Program (SHOP) NOFA until April 18, 2011.

    Summary:  This notice provides public housing agencies (PHAs) with instructions for operating subsidy calculation submissions in Calendar Year (CY) 2011 as funded from Federal Fiscal Year (FFY) 2011 appropriations.  PHAs shall submit forms HUD-52723 and HUD-52722 electronically for each project to their local HUD field office in Excel Tools. Instructions for completing and submitting the Tools, along with other required forms and supporting documentation, will be posted on the Asset Management Project-Based Funding web page. PHAs will be notified through their field offices when these instructions are posted to the web page.

    Summary:  The United States Housing Act of 1937 requires that assistance contracts signed by owners participating in the Department’s Section 8 housing assistance payment programs provide annual adjustment to monthly rentals for units covered by the contract. HUD's Notice announces revised Contract Rent AAFs for adjustment of contract rents on assistance contract anniversaries.  The factors are based on a formula using residential rent and utility cost changes from the most current annual Bureau of Labor Statistics Consumer Price Index (CPI) survey. These factors are applied at Housing Assistance Payment (HAP) contract anniversaries for those calendar months commencing after the effective date of this Notice. HUD will publish ‘‘Renewal Funding AAFs,’’ in a separate Notice, to be used exclusively for renewal funding of tenant-based rental assistance, if so required in the fiscal year (FY) 2011 HUD Budget.

    Summary:  This information is required by the grant application to assist the Department in selecting the Department in selecting the highest ranked applicants to receive funds under the Section 3 Program Implementation and Coordination NOFA. The information collected from quarterly and final progress reports will enable the Department to evaluate the performance of agencies that receive funding and determine the effectiveness of the funding for increasing the capacity of
    recipient agencies to comply with the regulatory requirements of Section 3.

    Summary:  HUD announces the availability on its Web site of the applicant information, submission deadlines, funding criteria, and other requirements for HUD’s FY2010 Section 202 NOFA. Approximately $371 million in capital advance funds, plus associated project rental assistance contract (PRAC) funds is made available through this NOFA, by the Consolidated Appropriations Act, 2010 (Pub. L. 111–117, approved December 16, 2009). The Section 202 program provides funding for the development and operation of supportive housing for very low-income persons 62 years of age or older.  Applicants planning to submit an application in response to this NOFA should also review HUD’s Fiscal Year 2010 Notice of Funding Availability (NOFA) Policy Requirements and General Section that HUD posted on June 7, 2010 (FR 5415–N–01) for program thresholds and additional information and instructions to assist in submitting an application.  The notice providing information regarding the application process, funding criteria and eligibility requirements can be found using the Department of Housing and Urban Development agency link on the Grants.gov/Find Web site at http://www.grants.gov/search/agency.do.     Summary: In accordance with the Privacy Act of 1974 (5 U.S.C. 552a), as amended by the Computer Matching and Privacy Protection Act of 1988 (Pub. L. 100–503), and the Office of Management and Budget (OMB) Guidelines on the Conduct of Matching Programs (June 19, 1989, 54 FR 25818), and OMB Bulletin 89–22, ‘‘Instructions on Reporting Computer Matching Programs to the Office of Management and Budget (OMB), Congress and the Public,’’ HUD is issuing a public notice of its intent to conduct a recurring computer matching program with VA to utilize HUD’s Credit Alert Interactive Verification Response System (CAIVRS), with VA’s debtor files. Additionally, the record to be matched section was updated to reflect HUD’s new Privacy Act Systems of Records involved in the
    CAIVRS matching program.  HUD's update does not change the authority and the objectives of the existing HUD and VA computer matching program.

    Summary:  HUD's notice requests public comment regarding the manner in which HUD calculates the trend factor used in the Fair Market Rent (FMR) estimates to meet the statutory requirement that FMRs be ‘‘trended so the rentals will be current for the year to which they apply’’. HUD provides several proposed alternatives to the current trend factor and requests comments on these alternatives as well as suggestions of other ideas.

    Summary: In accordance with Executive Order 13563, ‘‘Improving Regulation and Regulatory Review,’’ HUD is reviewing its existing regulations to evaluate  their continued effectiveness in addressing circumstances for which the regulations were promulgated. As part of this review, HUD invites public comments to assist  in the development of a plan for periodically analyzing existing significant regulations to determine whether they should be modified, streamlined, expanded, or  repealed. HUD also seeks comment to identify specific current regulations that may be outdated, ineffective, or excessively burdensome. The purpose of this regulatory review is to make the Department’s regulations more effective and less burdensome in achieving HUD’s mission to create strong, sustainable,  inclusive communities, and quality affordable homes for all.

    Summary:  This Notice provides guidance to public housing authorities (PHAs) and others on how to manage compliance with public housing requirements when undertaking a financing that is not secured by public housing assets. Specifically, PHAs may not provide recourse to public housing assets as defined herein to their lender or financier.  The Notice provides for certain requirements when pursuing a financing that is not secured by public housing assets, and states guidelines for what HUD requires for those financings, as well as what HUD specifically does not require of the PHAs. To help maintain compliance with public housing requirements, PHAs should review and follow the guidelines provided in this Notice.

    Summary: The changes implemented by this interim rule are intended to enhance the efficiency and utility of HUD’s Public Housing Assessment System (PHAS). The interim rule makes 2 sets of amendments to improve evaluation and oversight of the Public Housing Program. First, it amends the PHAS regulations for the purposes of: consolidating the regulations governing assessment of public housing in one part of the Code of Federal Regulations (CFR); revising certain PHAS regulations based on HUD’s experience with PHAS since it was established as the new system for evaluating a public housing agency (PHA) in 1998; and updating certain PHAS procedures to reflect recent changes in public housing operations from conversion by PHAs to asset management. Second, this interim rule establishes new regulations that specify the actions or inactions by which a PHA can be determined to be in substantial default, the procedures for a PHA to respond to such a determination or finding, and the sanctions available to HUD to address and remedy substantial default by a PHA.
