    Summary:  This notice provides public housing agencies (PHAs) with instructions for the implementation of the PHAS Interim Rule, which will be published February 23, 2011.  PHAs with FYE December 31, 2010 will be scored in accordance with existing Transition Year Two Extended guidance. PHAs will be required to submit their management operations certification, unless they submit a waiver request within 30 days of the publication of this notice.  PHAs with FYE March 31, 2011 and forward will be assessed in accordance with the Interim Rule.

    Summary: This proposed rule combines and streamlines the former legacy public housing modernization programs, including the Comprehensive Grant Program (CGP), the Comprehensive Improvement Assistance Program (CIAP), and the Public Housing Development Program (which encompasses mixed-finance development), into the Capital Fund Program (CFP). This rule proposes a change to the Public Housing Agency Annual Plan regulation to incorporate the  definition of qualified public housing agencies (PHAs), which was mandated by the Housing and Economic Recovery Act (HERA) of 2008, and to decouple or  separate the CFP informational requirements from the PHA Annual Plan requirements. Also proposed is the ability for PHAs to request a total development cost  (TDC) exception for integrated utility management, capital planning, and other capital and management activities that maximize energy conservation and efficiency, including green construction and retrofits, which include windows; heating system replacements; wall insulation; site-based generation; advanced  energy savings technologies, including renewable energy generation; and other such retrofits. The structure of the proposed Public Housing Capital Fund  Program regulation is described in section IV of the SUPPLEMENTARY INFORMATION. Several regulations would be eliminated with the implementation of this  rule, along with the issuance of new and/or revised CFP forms, including the CFP Annual Statement/Performance and Evaluation Report (form HUD–50075.1), CFP 5-Year Action Plan (form HUD– 50075.2), and the CFP Annual Contributions Contract (ACC) Amendment, as well as a new guidebook.

    Summary: This SHOP NOFA announces the availability of $26,730,000 in FY2010 SHOP funding to be awarded to national and regional nonprofit organizations and consortia to facilitate and encourage innovative homeownership opportunities on a geographically diverse basis through the provision of  self-help homeownership housing programs.  Grant funds may be used for land acquisition, the installation or improvement of infrastructure, and for  reasonable and necessary planning, administration and management costs.  The average SHOP expenditure for the combined costs of land and  infrastructure may not exceed $15,000 per dwelling unit.  SHOP homeowners must contribute a significant amount of sweat equity towards the purchase of  their units.  Donated volunteer labor is also required.  Assisted units must be decent, safe, and sanitary non-luxury dwellings that comply with local building and safety codes and standards.  These units must be sold to eligible low-income homebuyers at prices below the prevailing market price.  The homebuyer’s sweat equity contribution may not be  mortgaged or otherwise restricted upon future sale of the SHOP unit.  SHOP grantees may award SHOP funds to affiliates to carry out the grantee’s SHOP  program.

    Summary: HUD announces the availability on its website of the applicant information, submission deadlines, funding criteria, and other requirements for the HUD’s FY 2010 Service Coordinators in Multifamily Housing NOFA.   The Service Coordinator in Multifamily Housing program allows multifamily housing owners to assist elderly individuals and nonelderly people with disabilities living in HUD-assisted housing and in the surrounding area to obtain needed supportive services from the community, to enable them to continue living as independently as possible in their homes.   $90 million in fiscal year 2010 funds have been appropriated for the Service Coordinator in Multifamily Housing program. Of these funds, approximately $31 million are available in this NOFA for funding new Service Coordinators in Multifamily Housing programs. Eligible applicants are owners of eligible multifamily assisted housing, as defined in Section III.A.2 of this NOFA may apply.  In any jurisdiction or neighborhood that receives funding, for either the same geographic area or the same population, HUD encourages coordination among programs, where appropriate. This will enable grant recipients to leverage shared resources, avoid duplication of services, and improve access and service delivery for participating families. These programs include Resident Opportunity for Self Sufficiency (ROSS) Service Coordinators, Public Housing Family Self-Sufficiency, Housing Choice Voucher Family Self-Sufficiency, HOPE VI Revitalization, Choice Neighborhoods, Elderly/Disabled Service Coordinators, HUD-VASH, Family Unification Vouchers, Service Coordinators in Multifamily Housing, Continuum of Care, and/or other special use housing assistance with services or service coordination.

    consider in determining whether to consent to an agreement between a PHA (or another owner entity) and a governmental or quasi-governmental body using eminent domain authority (taking body) regarding the taking of public housing property that was developed/acquired by, or is maintained with funds from the United States Housing Act of 1937.

    Summary:  This notice provides guidance to ensure that information submitted and maintained by PHAs in the Inventory Management System/PIH Information Center (IMS/PIC) Development Sub-Module is accurate, timely, and reliable. The Development Sub-Module collects and displays information about PHA developments, buildings, and units. Information entered by PHAs into the Development Sub-Module affects PHA funding, performance scores, and portfolio management; therefore, it must be accurate.

    The notice provides detailed information on unit tenant status categories, including: 1) an overview of the Categories and Sub-Categories; 2) updates to the unit status reporting notice that was published in 2010 (PIH Notice 2010-6); 3) instructions for obtaining a HUD-user approval in IMS/PIC; 4) a description of the contents and time-limits of Field Office Approval Letters; and 5) a detailed description of each Unit Tenant Status Category and Sub-Category.
