    Summary:  HUD’s notice amends PIH Notice 2010-40, by adding the following criteria for funding applications with tying scores.  Applications will be selected in order of points awarded until all funding is exhausted. At the end of the selection process, should funding not be available to support two or more applications with the same number of points awarded, a lottery will be held to select among these applications until all of the funding is exhausted. However, if any funding that remains is insufficient to fund the next application at the minimum number of project-based vouchers the PHA will accept, the remaining funding, if sufficient, may go to the next applicant at full funding or the minimum number of project-based vouchers the PHA will accept. If there are funds remaining that are insufficient to fund another application, the funds will be used to provide additional tenant-based HUD-VASH vouchers according to the geographic need of homeless veterans based on HUD and VA data.

    Summary: As the Nation’s housing agency, HUD administers programs designed to meet the goal of ensuring decent housing and suitable living environment for all. In pursuit of this goal, it is HUD’s responsibility to ensure that all who are otherwise eligible to participate in HUD’s programs have equal access to these programs and have the opportunity to compete fairly for HUD funds without being subject to arbitrary exclusion. There is evidence, however, that lesbian, gay,  bisexual, and transgender (LGBT) individuals and families are being arbitrarily excluded from some housing opportunities in the private sector. Through this  proposed rule, HUD strives to ensure that its core programs are open to all eligible individuals and families regardless of sexual orientation or gender identity.

    Summary:  This Notice reissues PIH Notice 2009-12, which provided processing information for PHAs regarding the allocation of the $3 billion in formula funds. A Notice of Funding Availability (NOFA) for the award of the $1 billion competitive grant funds was issued separately. FY 2009 Capital Fund Formula Grants were provided through a separate process.  This guidance provides Public Housing Agencies (PHAs) and HUD Field Offices with information and procedures for processing the additional amount of Fiscal Year 2009 Public Housing Capital Fund Grants provided in accordance with the American Recovery and Reinvestment Act of 2009 (“the Recovery Act”). This Notice applies to PHAs who received either a Capital Fund Formula and/or a Replacement Housing Factor (RHF) Fund Grant in Fiscal Year 2008 under the Capital Fund Program.

    Summary:  HUD's 18-page notice provides guidance on public housing agency (PHA) administrative responsibilities related to  family moves with continued assistance both within a PHA’s jurisdiction and portability moves.  In addition to reviewing the administrative responsibilities of the initial PHA and the receiving PHA for moves with continued assistance under portability, this Notice sets- forth additional requirements for PHAs who deny moves due to insufficient funding both within and outside the initial PHA’s  jurisdiction in accordance with 24 CFR 982.314(e)(1).  HUD's notice also:

    • Sets forth the penalties that may be imposed on PHAs that deny family requests to move on the basis of 24 CFR 982.314(e)(1) if the conditions necessary to deny the move on the basis of insufficient funding do not exist.  
    • Requires PHAs to notify HUD when it becomes necessary to deny families’ requests to move due to insufficient funding.
    • Requires receiving PHAs to provide a notification by email or other confirmed delivery method to the initial PHA on its intent to bill or absorb before the family is approved for the portability move.
    • Encourages PHAs to enlist the assistance of the local Area HUD Office in resolving billing related issues. 
    • Outlines the steps an initial PHA who does not receive annual updates for families under billing arrangements should take in seeking assistance from their Area HUD Office as well as receiving PHAs who do not receive timely payments from initial PHAs.
    • Updates the  latest portability guidance issued in HUD Notice PIH 2008-43 and supersedes that notice.

    Full Title: Notice of Public Interest (NOPI) for Fiscal Year 2010 Transformation Initiative: Homeless Families Demonstration Small Grant Research Program

    Publication Date: January 5, 2011

    Summary:  The purpose of this notice is to inform potential applicants that the Office of Policy Development and Research (PD&R) of the Department of Housing and Urban Development (HUD) is interested in receiving preliminary applications for grants to support research activities focusing on Homeless Families. This NOPI is governed by the information and instructions found in HUD’s Fiscal Year 2010 Notice of Funding Availability (NOFA) Policy Requirements and General Section that HUD posted on June 7, 2010 (FR 5415-N-01).

    The pre-application deadline date is February 18th, 2011. Applications must be received by Grants.gov by the deadline date.

    Full Title: Notice of Availability: HUD’s Fiscal Year (FY) 2010 NOFA for the Capital Fund Education and Community Facilities Program—Technical Correction and Extension of Deadline Date

    Pubilcation Date:  1/13/2011

    Summary: On October 18, 2010, HUD posted on http://www.Grants.gov its Notice of Funding Availability (NOFA) for the Fiscal Year (FY) 2010 Capital Fund  Education and Community Facilities (CFCF) Program. The NOFA made available approximately $35 million in assistance for development of facilities to provide early childhood education, adult education, and/or job training programs for public housing residents. Today’s Federal Register publication announces that HUD has posted on http://www.Grants.gov a technical correction that makes several corrections and clarification to NOFA. Specifically, the corrected NOFA clarifies that Public Housing Agencies (PHAs) may submit multiple applications, but each application must include only one site. HUD has also revised the NOFA to specify tie breaking criteria. Further, in order to provide applicants with sufficient time to submit new or revised applications that incorporate the corrections and clarifications to the NOFA, HUD has extended the application deadline to February 3, 2011.

    Potential applicants should review carefully the corrected NOFA to best determine whether to submit an updated application which incorporates the corrections and clarifications related to this notice. Applicants who submitted their applications prior to the technical correction notice can choose to submit an updated application that reflects the corrections and clarifications, but are not required to if they determine no changes are needed for their application. Applicants are reminded that if they submitted any portion of their application by fax with their initial application submission and choose to submit a revised application, then they will have to refax the materials after they submit the revised application to HUD. Please refer to the General Section for instructions regarding materials that are faxed and how HUD matches faxes to applications. For each site for which a PHA submits an application, the last version of the application received by http://www.Grants.gov by the deadline date, in accordance with the timely receipt requirements, will be the application that is reviewed and rated.

    The revised NOFA can be found and downloaded from http://www.Grants.gov, using the CFDA number for that program, 14.890.

    DATES: The revised application deadline date is February 3, 2011. Applications must be received by Grants.gov by 11:59:59 p.m. eastern time on the deadline date.     Purpose: On September 28, 2007, the Office of Inspector General (OIG) issued a report on over subsidization in the Housing Choice Voucher (HCV) program due to the issuance of vouchers with unit sizes greater than the number of family members in the household. Pursuant to the recommendation of the OIG, the Department issued clarifying guidance on the matter of categorization of live-in aides, other reasonable accommodation issues and corresponding data entry into the Public and Indian Housing Information Center (PIC) through the Notices cited above. The purpose of this Notice is to extend and revise Notice PIH 2009-22 (HA). Specifically, section 2.C has been added to explain subsidy standards in regard to live- in aides and their PHA-approved family member/s and section 3 has been revised to explain data entry in PIC for family members of live- in aides.

    Full Title: PIH Notice 2010-50: Effective Use of the Enterprise Income Verification (EIV) System's Deceased Tenants Report.to Reduce Subsidy Payment & Administrative Errors

    Publication Date: December 30, 2010

    Covered Programs:  This Notice applies to the following HUD-PIH rental assistance programs: Public Housing, Section 8 Moderate Rehabilitation, Project-Based Voucher, Project-Based Certificate; and Housing Choice Voucher programs.

    Purpose: This Notice explains the procedures Public Housing Agencies (PHAs) are required to implement to deal with families with deceased household members. The implementation of the procedures outlined in this Notice will ensure that PHAs submit accurate data to HUD via the Public and Indian Housing Information Center (PIC) and that PHAs do not make subsidy overpayment s on behalf of deceased single member households. Where overpayments have been made, the PHA will recoup the overpayment from the landlord/owner of the rental property under the programs noted in Section 3 of this Notice, with the exception of the Public Housing program.

    This notice makes the following changes:

    Section 7 of this Notice modifies PIH-2010-09 to include reference to Notice PIH-2010-15, which outlines requirements for safeguarding personally identifiable information, such as social security numbers. Section 8 of this Notice modifies PIH-2010-09 to remove the requirement that the PHA notify the live-in aide to vacate the unit by the end of the month; and Section 15 of this Notice modifies PIH-2010-09 to clarify minimum and maximum time frames allotted for the removal of personal belongings from a public housing unit when the sole household member dies; to provide examples of how to correctly apply this guidance; and remind PHAs that they must comply with local and state tenant/landlord laws. Section 14 of this Notice modified PIH 2010-09 to remind PHAs of the timely PIC reporting requirement for updated forms HUD-50058 in accordance with Notice PIH-2010-25.
