Section 8 Admin. Fees: Now You See 'Em
To help housing agencies (HAs) maximize their administrative fee earnings, this AudioShort will provide practical information on potential ways for them to cope with the challenges presented by the admin. fee and fee reserve provisions in the FY 2003 Appropriations bill and HUD’s implementation of them. Specifically, panelists will provide useful information for HAs to consider, that may help them avoid recaptures of their earned admin. fees and to add to their Section 8 administrative fee reserves in the future. Panelists will also provide an update on the Section 8 admin. fee lawsuit based on the FY 2003 bill.

The FY 2004 conference report created a pro-rata administrative fee formula for the first time in the history of the Section 8 Housing Choice Voucher program, which is based on the amount LHAs were eligible to receive in FY 2003. Given that FY 2003 featured a de facto expense-based administrative fee (requiring recaptured earnings in certain instances), what implications might the FY 2004 bill (pending final vote and enactment into law) have on your agency now and into the future? The FY 2004 conference report also contains ambiguous language limiting the use of Section 8 administrative fee reserves to activities related to the provision of Section 8 rental assistance, including related development activities. Further clarification is needed, but the FY 2004 bill may mark a dramatic change in the Federal government’s role over the purposes for which Section 8 administrative fee reserves could be spent beyond “other housing purposes.” Panelists will help you sift the finer points of the FY 2004 bill, and explain what you can do to retain your hard earned administrative fees.
