NAHRO Submits Comments on the Revocation of the 30-Day Notification Requirement

April 28, 2026 — Yesterday, NAHRO submitted comments regarding the rule titled “Revocation of the 30-Day Notification Requirement Prior To Termination of Lease for Nonpayment of Rent.” The rule would eliminate the 2021 interim final rule and 2024 final rule requiring PHAs and PBRA owners to provide tenants with 30-day notification prior to termination of lease for nonpayment of rent.
In the comment letter, NAHRO emphasizes support for the revocation citing past comments to the proposed rule published in 2023. The 30-day notification requirement, while well intentioned, has several potential negative impacts including legal confusion in states and localities; increasing the financial burden on PHAs; and long-term impacts on tenants facing eviction or prospective tenants on a waiting list.
NAHRO has recommended that HUD create pathways to further encourage residents to recertify their incomes, which can help prevent evictions for nonpayment of rent. Additionally, NAHRO has also recommended that HUD work with Congress to remove the 30-day notification requirement from statute. Although the rule related to this requirement is being removed, the provision
remains in the CARES Act. This has and will continue to create confusion nationally as there are various state and federal eviction notice requirements.
