HUD Sends FAQ on EHV-TPVs to Housing Agencies

By: Tushar Gurjal, Senior Policy Manager

October 27, 2026 – Earlier this month, HUD sent a frequently asked questions (FAQ) document to housing agencies on Emergency Housing Voucher Tenant Protection Vouchers (EHV-TPVs). As of the writing of this blog post, this document has not been published to HUD’s website but sent to housing agencies via email.

The substantive portions of the document have been reproduced below.

Frequently Asked Questions: Emergency Housing Voucher Tenant Protection Vouchers (EHV-TPVs)

Dear PHA:

On September 30, 2026, HUD published PIH Notice 2026-25, “Availability of Tenant Protection Vouchers for Emergency Housing Voucher Families.” Also on September 30, 2026, HUD sent each PHA a communication via DocuSign containing HUD’s preliminary estimates of the number of families for which the PHA would receive Tenant Protection Vouchers (TPVs). This DocuSign communication is referenced throughout the FAQs below. On October 6, 2026, HUD hosted a webinar reviewing the notice and answering questions submitted by PHAs. The slides from the webinar are attached to this email, and answers to some of the questions received are provided below.

General

Q. Who did HUD email at my PHA with the potential EHV-TPV award amounts?

A. HUD emailed the Executive Director email address provided by the PHA in the PIC system. If your PHA is unable to locate our email, please email [email protected].

Q. My PHA had a plan to convert all our EHVs to our HCV program using available turnover vouchers. Can we still do that?

A. Yes, your PHA can still convert EHVs to HCV. However, this must be completed by November 1, 2026.

Portability

Q. My PHA has some EHV families that have ported to another jurisdiction that is currently billing me. Which PHA will receive an EHV-TPV for ported-out vouchers that are currently in a billing arrangement?

A. Using available PIC data, HUD will award the EHV-TPV to the receiving PHA. Information on any ported-out vouchers was included in the original DocuSign communication HUD sent on September 30, 2026 (available in PIC), and HUD has emailed the receiving PHA directly regarding those vouchers.

Q. Are EHV-TPVs portable?

A. Yes. The regulations at 24 CFR Part 982 are applicable to EHV-TPVs.

HCV Policy and Reporting

Q. Can MTW PHAs apply MTW flexibilities to EHV-TPVs?

A. Generally, yes. EHV-TPVs should be treated like any other TPV in the PHA’s portfolio, with the exception of reporting requirements and the fact that they cannot be reissued upon turnover.

Q. Do I need to put EHV families on the waiting list to receive an EHV-TPV?

A. No. EHV TPVs, like other TPVs, are non-waiting list vouchers under 24 CFR 982.203.

Q. Do I need to conduct an eligibility review, issue a new voucher, conduct a new inspection, and/or execute a new HAP contract for EHV-TPVs?

A. No. Because these families are currently assisted under EHV, which is a form of HCV assistance, they retain their existing eligibility determination, voucher, inspection, and HAP contract. The conversion from EHV to EHV-TPV does not interrupt assistance, so none of these actions is required.

Q. We have used a higher payment standard for the EHV program. When families transition to TPVs, do we have to begin calculating their rent using the applicable HCV payment standard?

A. Not immediately. For families remaining in the same unit, the protections at 24 CFR 982.505(c)(3)continue to apply. A PHA may not apply a decreased payment standard to calculate the family’s housing assistance payment earlier than two years after the effective date of the payment standard decrease and must provide at least 12 months’ written notice of any reduction that will affect the family. Consistent with its administrative plan, the PHA may also choose to retain the higher payment standard for as long as the family remains in the same unit

Families Between Units / Actively Searching

Q. How should I handle families that previously leased up under EHV but are between units with an active search voucher?

A. HUD will work with all PHAs that have families in these circumstances. For PHAs in shortfall, HUD will consider providing a limited exception to leasing restrictions in cases where PHAs have previously leased EHV families with active, unexpired vouchers who were between units on September 30, 2026.Contact [email protected].

Q. How should I handle families that previously leased up under EHV but are between units with an active search voucher if my PHA ha not previously been approved for a waiver under PIH Notice 2025-19 and have not added an EHV preference to my administrative plan. I am concerned about my ability to timely absorb these households into my HCV program. Will HUD provide waivers of administrative plan requirements to permit expedited changes to the plan?

A. PHAs may request that HUD use its statutory and regulatory waiver authority granted in paragraph(1) under the Tenant-Based Rental Assistance heading in division D of the Consolidated Appropriations Act, 2026 (Public Law 119-75), as continued by the Continuing Appropriations and Extensions Act,2027 (Public Law 119-103), to grant a waiver of such administrative plan requirements. If this is needed, please reach out to [email protected] for guidance on how to apply for a waiver to expedite updating your PHA’s administrative plan — specifically, adding a local preference to add a limited number of previously EHV-assisted families with active, unexpired vouchers who were not under lease at a unit on September 30, 2026, to your waiting list.

Funding

Q. Will the cost of EHV-TPVs be included in renewal costs for my CY27 HAP?

A. HUD will cover with renewal funding, assuming there are no constraints in the 2027 appropriations act constraints

Q. How will my January HAP be calculated to support the EHV-TPV families if HUD is only providing one month of TPV funding?

A. HUD will incorporate your anticipated EHV-TPV HAP expenses as part of your ongoing renewal needs, as we do for all “first-time renewals.” For more information on “first-time renewals,” please see PIH Notice 2026-12, page 4. As with all HAP renewal funding, this is subject to appropriations act provisions and funding availability.

Q. When should this transition to TPV be effective?

A. PHAs will be provided funding for EHV-TPVs effective December 1, 2026. PHAs should aim to have all TPVs families transitioned to the HCV program by that date.

Q. Will I receive special fees under PIH Notice 2026-12 for the conversion of EHV to TPV?

A. No. Those special fees are only available for the conversion of EHV to HCV or PBV.

Q. What will happen to remaining EHV administrative fees and HAP once all families are converted to EHV-TPVs?

A. HUD will issue additional guidance regarding EHV closeout. However, no later than December 31,2026, PHAs will no longer have EHV families under lease, and therefore there will be no more eligible use of EHV funds. Existing EHV administrative fees may not be used to cover administrative costs for EHV-TPVs. As part of the closeout process, PHAs must remit all unexpended EHV funds to HUD.
