HUD Reaffirms HOTMA July 1st Deadline for Public Housing and Housing Choice Voucher Programs

June 17, 2025 – On June 16, HUD sent an email to PHA executive directors reminding them that PHAs that administer the Housing Choice Voucher (HCV) or Public Housing (PH) programs would need to comply with certain provisions of the Housing Opportunity Through Modernization Act of 2016 (HOTMA) by July 1, 2025. These provisions include the following:
- New income exclusions (24 CFR 5.609(b));
- Certain definitions (24 CFR 5.100; 24 CFR 5.403; and 24 CFR 5.603); and
- Policies related to de minimis errors.
Two documents provide information about implementing these policies:
- Notice PIH 2024-38 titled “Housing Opportunity Through Modernization Act (HOTMA) Sections 102 and 104: Updated Guidance to Public Housing Agencies (PHAs) on Compliance”; and
- A frequently asked questions document titled “PIH HOTMA Implementation FAQs for PHAs – Questions Related to Notice PIH 2024-38.”
At this time, HUD has not finalized a deadline for the other provisions of HOTMA sections 102 and 104 because those “ . . . provisions require system updates for PHAs to properly implement and report to HUD . . . .”
Also, please note that while HUD has extended the compliance deadline for these provisions Multifamily Housing Owners, this deadline extension does not apply to PH and HCV (including project-based voucher) programs.
