HUD Releases Two Notices Related to HOME Program Requirements

April 30, 2026 — This week, HUD published two notices both titled “HOME Investment Partnerships Program: Further Program Updates and Streamlining,” which propose updates and revisions to the HOME final rule and indefinitely delays provisions green building standards (90 FR 16085) and tenant protections and selection (90 FR 746).
HOME Proposed Rulemaking, Comments Due June 1, 2026
After over a year of regulatory review of the HOME final rule, HUD is proposing several changes in their notice FR-6144-P-09. Most notably, HUD is proposing to revert to tenant protections as they existed prior to the 2025 final rule.
The Department makes specific revisions and updates, which include:
- Removing the prohibition against unreasonable interference or retaliation, which would prohibit owners from unreasonably interfering with a tenant’s safety or peaceful enjoyment of their rental housing unit and prohibit owner retaliation;
- Removing provision requiring owners to relocate a tenant during life threatening repairs;
- Removing unimplemented provisions related to permitting participating jurisdictions to exceed the maximum per-unit subsidy for projects that meet certain green building standards;
- Applying the requirement of immediate correction to projects only for life-threatening deficiencies not all health and safety deficiencies;
- Creating additional flexibilities related to scattered site manufactured housing rental projects;
- Adding statutorily required language providing that a minimum 30-day notice period is not required for the termination of tenancy or refusal to renew tenancy of a tenant when it is due to safety concerns; and
- Including NSPIRE carbon monoxide detector requirements for the HOME program.
The proposed rule would maintain language from the HOME final rule as it pertains to what constitutes as “good cause” for the termination of tenancy or the refusal to renew tenancy.
Indefinitely Delaying HOME Final Rule Tenant Protection and Green Building Standards Requirements
In Notice FR-6144-F-08, HUD indefinitely delays any requirements in the HOME final rule that are not yet in effect. Last year, HUD made several delays to when these provisions would go into effect. The first delay extended until October 30, 2025 and then the second delay extended until April 30, 2026.
The Department will make a final determination regarding tenant protection and green building standard requirements after comments are made on proposed rulemaking to the HOME program.
